What is required to prove a liquor liability lawsuit?
Proving liability is generally done through the use of witnesses or physical evidence. Tracing credit card transactions of minors to determine if their bank statements show any purchases of alcohol is one way to go about proving the liability of a bar. In order to establish liability on behalf of the bar, we must prove that the bar did in fact serve alcohol to a minor under the age of 21. The server must have knowingly served a minor or known that the person was under the age of 21 and that as a result of serving that minor, someone was hurt. Video cameras can also be used to identify whether the person was in fact a minor and also whether their appearance matches the ID that was used to purchase alcohol.
